Barking Bags is a partnership business and we provide terms and conditions for our customers. The family run business is based in England and we are governed by English law. We don't sell any information we might have about you. 

We employ proper systems to ensure that your information and financial details are secure when you shop with us. We expect you to pay for your goods and make reasonable allowances for their delivery. If there are problems with the goods or the delivery then please talk to us, we care about our customers and the products we sell and take the responsibility of customer satisfaction seriously. Goods are dispatched using Royal Mail. 

Payment

Internet sales are confined to the UK and other selected countries. If in doubt, contact us on info@barkingbags.co.uk with INTERNATIONAL SALES in the heading. Our internet site accepts Credit/Debit card payments, and these are processed by Shopify through their secure pages. We also offer the opportunity to pay using PayPal, Apple Pay and  Klarna. We do not store or have access to your credit/debit card details. All credit and debit cards are subject to validation checks and authorisation by the card issuer when you place an order. If the issuer of your payment card refuses or does not, for any reason, authorise payment to us, we will not be liable for any delay or non-delivery. Your products will not be dispatched until payment has cleared.

Paying by cheque is not possible. However, at shows and events we can accept electronic card payments.

Paying by bank transfer

Please contact us by email if you would like to pay by bank transfer and we will supply you with our bank details. Your products will not be dispatched until payment has cleared.

Returns

Please contact us within 14 days of receiving your item should you wish to return it. Items should be unused and in a resalable condition. You must pay the cost of returning an item. We suggest you use a signed for or insured method of delivery. Once we have received your item we will reimburse you for the cost of the item. Normally we do not reimburse the postage and packing as this is something we are not able to reclaim.

If you are returning an item for exchange, then you will need to pay for the delivery of the exchanged item. 

VAT

As a VAT registered company our products are subject to a VAT payment at point of sale. 

Liability

The total liability of Barking Bags for any claim howsoever arising shall not exceed the price of the goods supplied by Barking Bags to the customer, together with any postage and packaging costs incurred. Barking Bags shall not be liable for any consequential customer loss whether this arises from a breach of duty in contract or in any other way. Barking Bags cannot be held liable for any loss that you may suffer if a third party obtains unauthorised access to any data, including account details or details you provide us when accessing or ordering from www.barkingbags.co.uk.

Barking Bags will not be liable to you or in breach of contract for delay or failure to perform due to a cause beyond our reasonable control. Barking Bags will not be liable for any damage or injury arising out of any of the products purchased from the website or at shows and events. Barking Bags cannot be held liable for the misuse of any of the products we sell.

Product images and descriptions

Every care is taken to ensure descriptions and specifications of the products shown on our website are correct. The colour representation of fabrics is as accurate as possible given the limitations of website colouration and variation in computer monitors, and it is provided in good faith. Colours will vary to a small extent between different dye batches.

Barking Bags and the goods sold through it are subject to change without notice and we reserve the right to improve, alter or modify designs without prior notification.

Statutory rights
These Terms and Conditions do not affect your statutory rights. Every purchase made on www.barkingbags.co.uk website shall be deemed performed in England. The use of the website and the Terms and Conditions shall be governed, construed and interpreted in accordance with English law and you agree to submit to non-exclusive jurisdiction of the English court.

Pricing

Prices for our Goods may change from time to time, but changes will not affect any order you have already placed. The price of the good includes delivery charges. Our delivery charges are as advised to you during the online check-out process. 

Delivery Policy

Once your order has been placed and paid for, we aim to dispatch goods within 2 working days

UK

All goods are dispatched through Royal Mail using their 48 Tracked Service. Royal Mail aim to complete a delivery in a 2/3 day time frame. All goods are tracked and you will be informed of the tracking number for your order. If you are not at home when delivery is attempted, your goods will be taken to your local depot to collect. It is your responsibility to collect within the time frames of the postal service. Failure to collect will result in the package being returned to Barking Bags and an additional postage cost will need to be made before the package can be resent. When you make a purchase through the Barking Bags website, at checkout it is possible to leave a note to specify a safe place where the goods could be left but you do this at your own risk.

International deliveries

Buyers are responsible for any customs and import taxes that may apply as these fees are applied by your local customs office.  Barking Bags cannot be held responsible for delays due to customs.

Cancellation of Orders

Barking Bags accept cancellations up to seven working days after the day on which you place your order.

If you have received the goods before you cancel your order then you must send the goods back to our contact address at your own cost and risk. If you cancel your order but we have already processed the goods for delivery, you should not unpack the goods when they are received by you and you must send the goods back to us at our contact address at your own cost and risk as soon as possible.

Buyers are responsible for return shipping costs. If the item is not returned in its original condition, the buyer is responsible for any loss in value. The cost of both original and return postage and packing will be deducted from any refund.

Once you have notified us that you are cancelling your contract, any sum debited by us from your credit or debit card (minus any postage costs incurred) will be re-credited to your account as soon as possible, and in any event within 30 days of cancellation.

Cancellation of orders by us

We reserve the right not to process your order if:
1.  We have insufficient stock to deliver the goods you have ordered; or
2.  One or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information.

If we do not process your order for the above reasons, we will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit/debit card as soon as possible, but in any event within 30 days.

Protecting the integrity of the Design and Trademark

The bag design has been registered and is subject to the provision of Registered Designs Act 1949. Any attempt to copy the design will be taken to our lawyers.  

Barking Bags is the registered trade name for the company and has a Trademark,  defined by the UK Intellectual Property Office as the “sign which can distinguish our goods and services from those of our competitors”, in doing so it protects the integrity and investment of our company.
